DA challenges Speaker over unlawful appointments in Maquassi Hills

The Democratic Alliance (DA) strongly condemns the conduct of Speaker Sarah Nkatlo during two consecutive Special Council meetings held on 20 March 2026 and 2 April 2026.

The Speaker’s actions raise serious concerns regarding compliance with the Constitution, the Municipal Structures Act, and the Rules of Order governing council proceedings.

At both meetings, councillors were denied the opportunity to vote on the appointment of directors — a decision that strikes at the heart of democratic governance.

This conduct constitutes a breach of:

  • Section 160(8) of the Constitution of the Republic of South Africa, 1996
  • Section 36 of the Local Government: Municipal Structures Act, 1998
  • The Rules of Order of Maquassi Hills Local Municipality

The implications of this conduct are deeply concerning. It undermines the rule of law, erodes accountability in the appointment of senior municipal officials, and damages public confidence in the integrity of the municipality.

The DA notes that the Mayor has already formally written to the Minster for Cooperative Governance and Traditional Affairs, Mr Velenkosini Hlabisa, calling for intervention in this matter. This underscores the seriousness of the situation and the urgent need for decisive action.

Furthermore, the DA, together with a majority of councillors, is currently considering legal action to challenge the validity of these appointments.

The DA remains steadfast in its commitment to defending constitutional democracy and the rule of law. The people of Maquassi Hills deserve a Council that operates with integrity, transparency, and respect for democratic processes.

Denying elected representatives their right to vote is not only unlawful but a direct betrayal of public trust. Urgent corrective action is required to restore the credibility of the council and protect the integrity of local government.
